Speed and evidence decide the outcome. The first week matters more than the following year.
First, secure the evidence
Then, in parallel
- Written complaint to the society or development authority, asking them to record the encroachment and refuse any transfer
- Application to the Overseas Pakistanis Commission of the relevant province (Guide 27)
- Complaint under the Illegal Dispossession Act where it applies (Guide 26)
- Written application to the Deputy Commissioner and the district police officer
- A civil suit for possession, with an application for interim injunction to stop further construction
Do not negotiate first. Any payment or arrangement made before the record is secured can later be characterised as consent to the occupation.
